Concept of Supply

Section 7 - Meaning and scope of supply

Section 7(1)

Provisions of scope of supply under CGST Act have also been made applicable to IGST Act vide section 20 of the IGST Act


In detail


Section 7(1)(b)

Eg :
Ramaiyaa, a proprietor, has received the architect services for his house from an architect located in New York at an agreed consideration of $ 5,000. The import of services by Ramaiyaa is supply under section 7(1)(b) though it is not in course or furtherance of business.

Section 7(1)(c) - Schedule I activities  - without consideration - in the course of business


                I.Permanent Transfer/Disposal of Business Assets

Eg: transfer of business assets from holding to subsidiary company for nil consideration.

                II.Supply between related person or distinct persons

    1. Related persons

a) Such persons are officers/directors of one another’s business

b) Such persons are legally recognised partners


c) Such persons are employer & employee

d) A third person controls/ own/ holds (directly/ indirectly) ≥ 25% voting stock/shares of both of them

e) One of them controls (directly/indirectly) the other

f) A third person controls (directly/indirectly) both of them

g) Such persons together control (directly/indirectly) a third person

h) Such persons are members of the same family

i) One of them is the sole agent/sole distributor/sole concessionaire of the other

2. Distinct Persons specified under section 25

a) More than one registration in a State/ Union territory

b) Two establishments of a person in two different States/Union territories shall be treated as establishments of distinct persons.

Negative list under GST - Schedule III

a) Service  by employee to employer in employment

b) Services by any court or Tribunal

c) Functions by Members of Parliament, State legislature, local authority

d) Duties by a person in consitutional capacity

e) Duties of person in a body body established by the Central Government or a State Government or local authority

f) Services of funeral, burial, crematorium or mortuary including transportation of the deceased

g) Sale of land/building

h) Actionable claims, other than lottery, betting and gambling.


Section 7(2)(b)

Services notified by government are excluded from supply

Services by way of any activity in relation to a function entrusted to a Panchayat under article 243G of the Constitution has been notified for this purpose.

GST Yathra-1 - Some Important Definitions

Definitions 
  
1. Goods 
   
 means every kind of moveable property

 means anything other than goods, money and securities
   
 but includes activities relating to use  of money or currency conversion for which a separate consideration is charged

 a) any trade, commerce, manufacture, profession, vocation, adventure, wager or any similar activity, whether or not for pecuniary benefit
   
 b) incidental to a
   
 c) any activity or transaction in nature of a, whether or not there in volume, frequency, continuity or regularity
   
 d) supply or acquisition of goods including capital assets and services in connection with closure of business
   
 e) provision by club, body, association, society, or any such body (for subscription or other consideration) of facilities to its to members
   
 f) admission to a premises for consideration
   
 g) services supplied by a person as the holder of an office which has been accepted by him in the course or furtherance of his trade, profession or vocation;
   
 h) services provided by a race club by way of totalisator or a licence to book maker in such club
   
 i) any activity or transaction undertaken by the Central Government, a State Government or any local authority in which they are engaged as public authorities
   
4. Person  
   
 a) An individual + HUF +  Firm + LLP + Company+ Body corporate incorporated outside India + AOP/BOI   + Trust +  AJP
   
 b) A local authority + Central/State Government
   
 c) Any corporation established  under any law + Government company
   
 d) A Co-operative society + A Society registered under Societies Registration Act, 1860
   
5. Consideration 
   
 a) any payment,whether in money or otherwise , whether by the recipient or by any other person
   
 b) the monetary value of any act or forbearance, whether by the recipient or by any other person
   
 c) Shall not include any subsidy given by the Central Government or a State
Government.
   
 d) Deposit in respect of goods or services not to be considered as payment unless the supplier applies such deposit as consideration
   
6. Approved vocational education course: means, -
a. National Council for Vocational Training or State Council for Vocational Training offering courses in designated trades notified under the Apprentices Act, 1961 or

b.  Modular Employable Skill Course, approved by the National Council of Vocational Training, run by a person registered with the Directorate General of Training, Ministry of Skill Development and Entrepreneurship



7. Charitable activities:

 means activities relating to -

(i) public health by way of,-

(A) care or counseling of

(I) terminally ill persons or persons with severe physical or mental disability;
(II) persons afflicted with HIV or AIDS;
(III) persons addicted to a dependence-forming substance such as narcotics drugs or alcohol; or
(B) public awareness of preventive health, family planning or prevention of HIV infection;

(ii) advancement of religion, spirituality or yoga;
(iii) advancement of educational programmes or skill development relating to,-
(A) abandoned, orphaned or homeless children;
(B) physically or mentally abused and traumatized persons;
(C) prisoners; or
(D) persons over the age of 65 years residing in a rural area;
(iv) preservation of environment including watershed, forests and wildlife;

Business and Economy news - July 2017

         
  • According to 2nd National Council of Applied Economic Research (NCAER) State Investment Potential Index (N-SIPI 2017) report - Gujarat retained top position in list of 21 states and UTs with most investment potential, followed by Delhi and Andhra Pradesh.
  • According to Asian Development Bank, India will achieve GDP growth rate of 7.4 % in 2017-18 and 7.6 % in 2018-19.
  • Banking Regulation (Amendment) Bill 2017 presented in Lok Sabha, seeking to amend Banking Regulation Act 1949 and replace Banking Regulation (Amendment) Ordinance 2017. It authorises RBI to -
    • Direct banking companies to resolve the problem of stressed assets and Initiate insolvency resolution process on specific stressed assets.
    • Issue other directions for resolution, appoint or approve authorities or committees to advise banking companies for stressed asset resolution. Recovery proceedings will be carried out under Insolvency and Bankruptcy Code 2016.
  • Chhattisgarh government will merge all district cooperative central banks (DCCBs) of state into a single State Cooperative Bank, to serve farmers with better and efficient banking facilities.
  • China based Asian Infrastructure Investment Bank (AIIB) approved USD 329 million loan to build access roads to 4,000 villages in Gujarat. 
  • FINO Payments Bank commenced operations as a payments bank. FINO Payments Bank is 4th entity to start functioning as a Payments Bank in India, after Airtel, India Post and Paytm.   • Government approved Labour Code on Wages Bill which will ensure a minimum wage across all sectors by integrating existing labour related laws. The Labour Code on Wages Bill consolidates the Minimum Wages Act 1948, Payment of Bonus Act 1965, Payment of Wages Act 1936 and Equal Remuneration Act 1976.
·         Government approved selling government’s entire 51.11% stake in Hindustan Petroleum Corp Ltd to Oil and Natural Gas Corp.Government is 51% owner of HPCL and 68% owner of ONGC. HPCL's addition will make ONGC third-largest refiner in country after IOC and Reliance Industries.
  • ICICI Bank will be selling personal loans of up to Rs 15 lakh through its ATMs.
  • Infosys co-founder Nandan Nilekani along with venture capitalist Sanjeev Aggarwal has launched a $100 million venture fund called Fundamentum to back mid-stage startups that solve unique Indian problems in consumer technology space.
  • RBI imposed penalty of Rs. 3 crore on Union Bank of India for non-compliance with directions on Know Your Customer (KYC) norms. 
  • Punjab National Bank (PNB) will block all Maestro debit cards from 31st of July 2017 if card holders do not replace it with a more secure EMV chip based card by end of July.
  • Reliance Industries Limited (RIL) for the first time crossed Rs 5 lakh crore in market capitalisation. RIL is second firm to cross Rs 5 lakh crore in market capitalisation and is also currently most valued company in India. Tata Consultancy Service (TCS) was first company to hit Rs 5 lakh crore in market capitalisation milestone in July 2014.
  • Lok Sabha passed Companies (Amendment) Bill 2016 to amend Companies Act 2013, to strengthen corporate governance standards, initiate strict action against defaulting companies and help improve the ease of doing business in India.

நட்பு எப்படி உடைகிறது - காரணங்கள்.

இரண்டு நண்பர்களில் ஒருவர், மற்றொருவர் வேலைப்பளுவில் (பிசியாக) இருக்கிறார் என்று நினைக்கலாம்.
எனவே அவரை தொடர்பு கொண்டு பேசினால் அது அவருக்கு தொந்தரவாக இருக்கும் என்று நினைத்து தொடர்பு கொள்ளாமல் இருக்கலாம்.
காலம் செல்லசெல்ல "நாம் ஏன் தொடர்பு கொள்ள வேண்டும்..
அவர் நம்மை தொடர்பு கொள்ளட்டுமே" என்ற சிந்தனை உருவாகும்.
மேலும் சிறிது காலம் செல்லும்போது இது மற்றொரு விதத்தில் தீவிரப்படும்.
அதாவது, அவர் நம்மை முதலில் தொடர்பு கொள்ளட்டும்..
பிறகு நாம் பேசுவோம் என்று நினைப்பு இருவரின் மனதிலும் பரஸ்பரம் தோன்றும்.
இங்கு என்ன ஆகிறது? நட்பால் விளைந்த அன்பு வெறுப்பாக மாறுகிறது.
இறுதியில் அவ்விரு நண்பர்களுக்குள் தொடர்பு இல்லாமல் போனதால், நட்பால் விளைந்திருந்த பசுமை நினைவுகள் மறந்து போகிறது.
ஒருவர் மற்றொருவரை மறந்து போகிறார்.
எனவே நட்பு தொடர்ந்து நீடிக்க அடிக்கடி நண்பர்களை தொடர்பு கொள்ளுங்கள்.
நட்பு சிறக்க பத்து பொன் விதிகள்:
1 . ஆனால் நட்பு இருக்கிறதா என்பதை சோதித்துப் பார்க்க சோதனை ஏதும் வைக்காதீர்கள்.
2 . மேலும் நண்பரிடம் உதவி ஏதும் கேட்க நினைத்தால் அவரின் நிலை அறிந்து கேளுங்கள்.
3. நண்பரே குறிப்பறிந்து உதவி செய்தால் அதற்கு நன்றி தெரிவியுங்கள்.
4. ஆனால் அதே நேரத்தில் நாம்தான் அவருக்கு உதவி செய்திருக்கிறோமே என்று அவரிடமிருந்து பிரதி உதவி எதிர்பார்க்காதீர்கள்.
5. நண்பர் உதவவில்லையானால் " அவருக்கு என்ன சூழ்நிலையோ,
கஷ்டமோ தெரியவில்லை?" என்று நினைக்கப் பழகுங்கள்.
6. உதவ முடியாத நிலைக்கு நண்பர் வருத்தம் தெரிவித்தால், அதை ஏற்றுக்கொண்டு பழையபடி நட்பை தொடருங்கள்.
7. நண்பருக்கு கஷ்டம், துன்பம் என்று கேள்விப்பட்டால் அதை அறிந்து முடிந்த உதவி செய்யுங்கள். பக்கத்துணையாக நில்லுங்கள்.
நல் ஆலோசனை நல்குங்கள்.
8 . நண்பர் தன் கஷ்டத்தை முதலில் சொல்லட்டும், பிறகு உதவி செய்யலாம் என்று இருப்பது நட்புக்கு நன்று அல்ல.
9 . அதே போன்று நண்பர்களிடம் சோகத்தை பகிர்ந்து கொண்டால் அது பாதியாகும்.
10 . அவ்வாறே மகிழ்ச்சியை பகிர்ந்து கொண்டால் அது இரட்டிப்பாகும்.

Business and Economy news - June 2017


1. a.)According to Reserve Bank of India (RBI), India’s current account deficit (net difference between inflows and outflows of foreign currencies) narrowed during 2016-17 to 0.7% of the GDP, from 1.1% in 2015-16 due to India's trade deficit narrowing down to $112.4 billion in 2016-17 from $130.1 billion in 2015-16.

b.) Net FDI inflows  in 2016-17 got narrowed to $35.6 billion from $36 billion during 2015-16.

c.) Finance Ministry asked all ministries tasked with clearing foreign direct investment proposals in the 12 sectors that require government’s nod to take a decision on such proposals within 60 days. It is being done to speed up the FDI Process.

2. According to UNCTAD’s World Investment Report 2017, US, China and India are top 3 FDI Receiving Destinations.  FDI inflows into India remained USD 44 billion.

3. Asian Infrastructure Investment Bank (AIIB) approved $150 million equity investment loan for India Infrastructure Fund as AIIB’s first equity investment to fund private projects. IIIF will invest this amount in mid-cap infrastructure companies in India.

4. Employees Provident Fund Organisation (EPFO) signed MoU with Housing and Urban Development Corporation (HUDCO) to enable members of its housing scheme to avail subsidy and interest subvention under Pradhan Mantri Awas Yojana (PMAY). Under housing scheme, EPFO allows its subscribers for withdrawing up to 90 % of their EPF accumulations to buy homes.

5. Government approved Initial Public Offer of Indian Renewable Energy Development Agency Limited, for issuing 139000000 fresh equity shares of Rs.10 each to The public.

6. Government approved Securities and Exchange Board of India (SEBI) to enter into 2 separate MoUs with Securities market regulators of the European Union and Iran.

7. Government approved introducing Financial Resolution and Deposit Insurance Bill 2017 that will provide resolution framework for financial sector entities to deal with bankruptcy situation in banks, insurance companies, and other entities.

It will also result in repealing of the Deposit Insurance and Credit Guarantee Corporation Act, 1961 to transfer the deposit insurance powers and responsibilities to the Resolution Corporation.

8. Government approved recommendations of 7th Central Pay Commission (CPC) on allowances.

9. Government has cut interest rates on farmers' loans by 5 % (earlier 9% to now 4%), on loan up to Rs 3 lakh. Farmers who do not pay interest in time, will have to pay interest at rate of 7 %.

10.World Bank's Global Economic Prospects (GEP) projected GDP growth rate of 7.2% for India in 2017-18 as against 6.8% growth in 2016-2017. World bank also expects India’s growth rate to remain at 7.5% in 2018 and 7.7% in 2019. Global growth forecast in 2017 and 2018 at 2.7% and 2.9% respectively. 

 HSBC (Hongkong and Shanghai Banking Corporation) Predicted India's GDP Growth To Remain 7.1 %                 In 2017-18. As per Official Data, India's GDP grew 6.1 % during January-March Quarter (Q4 2017) and GDP growth rate for full year (2016-17 ) remained 7.1 %.

11.India signed $275 Million Loan agreement with Manila (Philippines) based Asian Development Bank (ADB) for improving urban services in 64 small towns in State of Madhya Pradesh.

12. Kerala Passed State State Goods and Services Tax (SGST) Act, leaving J & K as only remaining state to not have passed State GST, which is to be implemented from July 01, 2017.

13. RBI identified 12 bank accounts constituting nearly 25% of gross bad loans for immediate referral and resolution under the bankruptcy law. Each of 12 identified accounts was having more than 5,000 crore rupees of outstanding loans.

14. National Stock Exchange (NSE) launched its international exchange in the Gujarat International Finance Tec-City (GIFT City). NSE IFSC Ltd (global exchange promoted by NSE) will remain operational for a longer period than NSE during a trading day.

15. RBI has placed Central Bank of India and Bank of Maharashtra under prompt corrective action (PCA) which puts restricts on banking activities such as from lending, hiring and expanding branches. RBI has so far triggered PCA for 6 banks – IDBI Bank, UCO Bank, Dena Bank, Indian Overseas Bank, Central Bank of India and Bank of Maharashtra.

RBI has so far triggered PCA for 6 banks – IDBI Bank, UCO Bank, Dena Bank, Indian Overseas Bank, Central Bank of India and Bank of Maharashtra.

17.In the RBI second bi-monthly monetary policy review of 2017 only change in Monetary Policy is that RBI has cut Statutory Liquidity Ratio (SLR) by 50 basis points to 20% (To be applicable from June 24, 2017). RBI reduced growth projection for the current fiscal to 7.3% from 7.4%.

18. Securities and Exchange Board of India (SEBI) approved Telenor India's Merger with Bharti Airtel. The deal is now pending final approval by other authorities such as CCI (Competition Commission of India).

19. World Bank approved USD 250-million loan for Skill India mission, aimed at making Indian youth more employable through reskilling. SIMO is a 6 year programme in support of National Policy for Skill Development and Entrepreneurship (2017-23). Under this, persons in age group of 15-59 will acquire skill training irrespective of their employment status.

20. Rajesh Lodha, the former CFO of Piramal Enterprises has been appointed as the MD and CEO of Shriram Capital.

21. Public Sector Banks will need Rs. 95,000 Crore more by FY 2019 as their NPA-s will increase through 2019, forecasts a recent report of Moody's investor services.

GST- E- Commerce Provisions

Electronic commerce means supply of goods and/or services including digital products over digital or electronic network;
Electronic commerce operator means any person who owns, operates or manages digital or electronic facility or platform for electronic commerce;
The provisions relating to electronic commerce are governed by Section 8(4) and Section 56 of the Central/State Goods and Service Tax Act, 2016.

Liability to pay GST
Section 8(4) of the act states that the central or a State Government may, notify certain categories of services tax on which shall be paid by electronic commerce operator

If the electronic commerce operator does not have a physical presence in the taxable territory, any person representing such electronic commerce operator for any purpose in the taxable territory shall be liable to pay tax

If the electronic commerce operator does not have a physical presence in the taxable territory and also he does not have a representative in the said territory, such electronic commerce operator shall appoint a person in the taxable territory for the purpose of paying tax and such person shall be liable to pay tax.

TCS liability

Section 56 of the act states that in respect of other than services notified under Section 8(4), the electronic commerce operator, not being an agent, shall collect tax at source at the rate of one percent net value of taxable supplies made by it during the month, provided the consideration for such supplies have been collected by the electronic commerce operator.

Hence the responsibility to collect TCS arises only
 a)   if he does not supply the goods or services specified under section 8(4)
       b)   if he does not act in the capacity of agent and
       c)    if the consideration is collected by the electronic commerce operator himself.

Here the term “net value of taxable supplies” means the value of taxable supplies of goods or services as reduced by the aggregate value of taxable supplies returned to the suppliers.

The amount collected as TCS shall be deposited to the government within ten days from the end of the month of collection.

Every such electronic commerce operator such furnish a return in GSTR-8 containing details supplies made by it, returned to it and amount collected as TCS within 10 days from the end of month of collection.
The supplier of the goods or services who supplied through electronic commerce operator can claim the credit of TCS in his electronic cash ledger.

The details in the return GSTR-8 will be matched with the GSTR-1 return of the supplier. If there is a discrepancy in the details furnished between both the returns, the discrepancy will be communicated to both the supplier and electronic commerce operator and the shall be asked to rectify the same.

If the discrepancy is not rectified, the output tax liability would be added to the supplier and the supplier shall pay the GST liability.
